Staffan Teste, Bildombudsmannen AB, works as Picture ombudsman for Nordic countries. If you have problem to receive money from a buyer we can help you. We are involved in infringements of pictures owned by small copyright owners to big rights holders and picture agencies. As long as you own the copyright we will help you.
Since 1977 we have helped several hundred copyright owners to receive money from a few thousand crowns to half a million. During late 90-ties we helped 18 picture agencies to receive about one million crowns from a collecting society. We help copyright owners and picture buyers to write fair contracts. We have also helped models to receive what they should and helped people, who have been unlawfully used in advertising.
Teste is also working for BLF the Swedish organisation for photo companies and agencies in Sweden, second largest organisation of that kind in Europe and a member of Cepic.
Staffan Teste has experience in International law in his position as a former member of the board of the European Picture agency organisation Cepic. He has represent Cepic in the World Intellectual Organisation, WIPO and in EU-hearings.
Companies outside Sweden use Bildombudsmannen to help them with their problems in the picture world. Bildombudsmannen represent members of Picscout www.picscout.com on Nordic countries. Staffan Teste is member of an International law discussion group in Cepic. Every year lawyers from that group meet at Cepic conference in Europe.

Kent Ekeroth vann upphovsrättsmål mot Svenska Dagbladet
Lunds tingsrätt dömde på fredagen Svenska Dagbladet att betala Kent Ekeroth 18 000 kr för intrång i hans upphovsrätt genom att publicera stillbilder och filmer. Kent Ekeroth hade begärt just 18 000 kr för det otillåtna utnyttjandet. Tingsrätten konstaterade också att det stred mot god sed att SVD inte namngav Ekeroth som upphovsman. Däremot anser tingsrätten att det inte var visat att upphovsmannen lidit någon skada av brottet gentemot god sed och dömer inte ut något skadestånd för detta.
Tingsrätten dömer också ut full rättegångsersättning för Ekeroth.
- Det är glädjande att Lunds tingsrätt bifaller helt Ekeroths krav på ersättning för intrång och ersättning, säger Staffan Teste, Bildombudsmannen AB som företrätt Ekeroth i Lund. Det visar att det inte går att utnyttja en upphovsmans material utan att fråga först.
- Det som är oroande för upphovsmännen generellt är att rätten inte vill ersätta för brott mot god sed, nämligen att utelämna namn på upphovsmän. Rättens formulering att det inte är visat någon skada för att upphovsmannens namn utelämnas rimmar illa med den branschpraxis som gäller. Rätten uttalar sig också om att eftersom det inte är en professionell fotograf/filmare som svarat för skapandet av foto och film skulle ersättningen vara lägre. Det bryter mot två hovrätters domar som tidigare förklarat att det saknar betydelse när det gäller att utdöma ersättning huruvida upphovsmannen är amatör eller ej.
