Staffan Teste, Bildombudsmannen AB, works as Picture ombudsman for Nordic countries. If you have problem to receive money from a buyer we can help you. We are involved in infringements of pictures owned by small copyright owners to big rights holders and picture agencies. As long as you own the copyright we will help you.
     Since 1977 we have helped several hundred copyright owners to receive money from a few thousand crowns to half a million. During late 90-ties we helped 18 picture agencies to receive about one million crowns from a collecting society. We help copyright owners and picture buyers to write fair contracts. We have also helped models to receive what they should and helped people, who have been unlawfully used in advertising.
     Teste is also working for BLF the Swedish organisation for photo companies and agencies in Sweden, second largest organisation of that kind in Europe and a member of Cepic.
   Staffan Teste has experience in International law in his position as a former member of the board of the European Picture agency organisation Cepic. He has represent Cepic in the World Intellectual Organisation, WIPO and in EU-hearings.
     Companies outside Sweden use Bildombudsmannen to help them with their problems in the picture world. Bildombudsmannen represent members of Picscout www.picscout.com   on Nordic countries. Staffan Teste is member of an International law discussion group in Cepic. Every year lawyers from that group meet at Cepic conference in Europe.

Redigerade bilder

Hej!
Mitt företag säljer produkter ifrån Kina och vi köper alltid in våra varor via aliexpress.com. Via våra leverantörer på aliexpress.com har vi tillgång till bilder på dessa produkter. Dessa bilder kan vi använda på vår hemsida, facebooksida, ja som produktbilder helt enkelt.

Nu har vi fått en fet faktura av ett annat företag som hävdar att vi har stulit bilder från dom (2 bilder.) Båda bilderna är från Aliexpress.com dock har företaget ifråga lagt in en pytteliten skugga på deras bild. Dom har alltså redigerat bilden minimalt och dessvärre har vi råkat publicerat deras redigerade bild i tron om att detta var en aliexpress-bild.

Företaget har alltså inte själva tagit bilden utan den är ifrån aliexpress.com

Min fråga är: Har dom rätt att kräva oss på pengar för att dom minimalt har ändrat originalet med 1 pixel eller lagt till en skugga? Vi trodde självklart att detta var en aliexpress.com-bild efter som det är samma bild.

Eftersom ni säger att ni tar bilder från Aliexpress borde ni inte kunnat få tag i denna redigerade bild till er hemsida. Uppenbarligen har ni hämtat den från annan plats och det är det som är risken på Internet. det är inte tillåtet att hämta hem bilder från andras hemsidor utan tillstånd. Sedan är det en annan sak om bilden kan anses vara en ny skapelse eller inte. Avgörande är där vilka avtal som det fakturerande företaget har med bildleverantören. Har de rätt att utnyttja leverantörens bilder och skapa egna kan de ha rätt. Utan att se det exempel som ni anför och vilka avtal som finns i saken går det inte att ge ett fullständigt svar.
