Staffan Teste, Bildombudsmannen AB, works as Picture ombudsman for Nordic countries. If you have problem to receive money from a buyer we can help you. We are involved in infringements of pictures owned by small copyright owners to big rights holders and picture agencies. As long as you own the copyright we will help you.
     Since 1977 we have helped several hundred copyright owners to receive money from a few thousand crowns to half a million. During late 90-ties we helped 18 picture agencies to receive about one million crowns from a collecting society. We help copyright owners and picture buyers to write fair contracts. We have also helped models to receive what they should and helped people, who have been unlawfully used in advertising.
     Teste is also working for BLF the Swedish organisation for photo companies and agencies in Sweden, second largest organisation of that kind in Europe and a member of Cepic.
   Staffan Teste has experience in International law in his position as a former member of the board of the European Picture agency organisation Cepic. He has represent Cepic in the World Intellectual Organisation, WIPO and in EU-hearings.
     Companies outside Sweden use Bildombudsmannen to help them with their problems in the picture world. Bildombudsmannen represent members of Picscout www.picscout.com   on Nordic countries. Staffan Teste is member of an International law discussion group in Cepic. Every year lawyers from that group meet at Cepic conference in Europe.

Hej!
Vi är en ideell förening i Sverige som sysslar med kroatisk folkdans framförallt och med liknande aktiviteter för kroater i södra Sverige. Vid ett tillfälle för 2 år sedan skulle vi ha munk kväll i föreningslokalen och vi publicerade inbjudan till våra medlemmar via hemsidan www.jadran.se.
Bilden med några munkar som följde infon blev hämtad på Internet.

2 år senare, alltså i somras, fick vi ett krav från Getty Images om att vi använde deras bild utan köpekontrakt och de ville att vi skulle betala 7 100:- för bilden.
Bilden är borttagen för länge sedan, men de ska inte fria oss från betalningskravet.

Vad gäller för ideella föreningar i detta fall?

Getty har helt rätt med att begära ersättning för ert otillåtna utnyttjande av deras bild. Det är inte tillåtet att använda andras bilder utan tillstnd av upphovsmannen eller rättighetsinnehavaren. Det ni kan göra är att erkänna utnyttjandet, tala om att ni är en ideell förening och försöka komma överens om vilken ersättning ni skall betala. det har ingen betydelse att bilden är borttagen. Getty har förmodligen bevis för att bilden är använd och det räcker i händelse av en prövning i domstol. Ser man till prissättning för ett sdant intrång så är det ett lägre pris för utnyttjande av bilder av en ideell förening, se t.ex. BLF:s fooguiden www.blf.se däremot är det oaktsamt att utan tillstnd utnyttja annans bild så någon form av skadestånd kommer man inte undan i domstol.
