Staffan Teste, Bildombudsmannen AB, works as Picture ombudsman for Nordic countries. If you have problem to receive money from a buyer we can help you. We are involved in infringements of pictures owned by small copyright owners to big rights holders and picture agencies. As long as you own the copyright we will help you.
     Since 1977 we have helped several hundred copyright owners to receive money from a few thousand crowns to half a million. During late 90-ties we helped 18 picture agencies to receive about one million crowns from a collecting society. We help copyright owners and picture buyers to write fair contracts. We have also helped models to receive what they should and helped people, who have been unlawfully used in advertising.
     Teste is also working for BLF the Swedish organisation for photo companies and agencies in Sweden, second largest organisation of that kind in Europe and a member of Cepic.
   Staffan Teste has experience in International law in his position as a former member of the board of the European Picture agency organisation Cepic. He has represent Cepic in the World Intellectual Organisation, WIPO and in EU-hearings.
     Companies outside Sweden use Bildombudsmannen to help them with their problems in the picture world. Bildombudsmannen represent members of Picscout www.picscout.com   on Nordic countries. Staffan Teste is member of an International law discussion group in Cepic. Every year lawyers from that group meet at Cepic conference in Europe.

Vem äger bilderna? vem är upphovsrättsman?

Under 2010 hade jag en visstidsanställning, där mitt uppdrag var att fotografera och marknadsföra en kommun i samband med en filminspening Jag skrev på ett avtal som löd: "Allt material i form av text, bilder, foton, filmer och liknande som produceras inom ramen för anställningen ägs av arbetsgivaren (namnet på arbetsplatsen)"

Min dåvarande chef gick bort strax därefter och en ny chef kom.Idag, ger den nya chefen för arbetsplatsen bort mina bilder till tredje part, utan min vetskap. Hon hävdar även att hon kan göra som hon vill med mina bilder då jag skrev på avtalet att de äger bilderna. MEN är det fortfarande inte jag som är upphovsrättsman? den har jag väl inte sagt bort? Jag måste väl godkänna att hon isåfall ger bort/säljer alla mina bilder? Jag hade även muntligt avtal med den dåvarande chefen om att inga bilder skulle ges till tredje part, de som vi menade med "äger bilderna" då jag skrev på var att de äger rättigheterna att använda bilderna i det egna arbetet.

Det kan vara svårt att i efterhand tolka vad som menas i det avtal du skrev på. Du har inte skrivit bort upphovsrätten men väl den ekonomiska rätten. När bilderna används skall ditt namn (ideella rätten) anges. Kan du få din tidigare chef att intyga att dina bilder inte skulle ges bort till tredje part så bör du ha en chans att även bivra detta. Avtalet borde ha innehållit just det du muntligt avtalat att företaget endast övertog rätten att använda bilderna i den egna verksamheten. Det är det som vanligtvis gäller i dessa sammanhang. Vidareöverlåtelse till tredje part brukar vara en förhandlingsfråga från fall till fall där även upphovsmannen har rätt till ersättning.
