Staffan Teste, Bildombudsmannen AB, works as Picture ombudsman for Nordic countries. If you have problem to receive money from a buyer we can help you. We are involved in infringements of pictures owned by small copyright owners to big rights holders and picture agencies. As long as you own the copyright we will help you.
     Since 1977 we have helped several hundred copyright owners to receive money from a few thousand crowns to half a million. During late 90-ties we helped 18 picture agencies to receive about one million crowns from a collecting society. We help copyright owners and picture buyers to write fair contracts. We have also helped models to receive what they should and helped people, who have been unlawfully used in advertising.
     Teste is also working for BLF the Swedish organisation for photo companies and agencies in Sweden, second largest organisation of that kind in Europe and a member of Cepic.
   Staffan Teste has experience in International law in his position as a former member of the board of the European Picture agency organisation Cepic. He has represent Cepic in the World Intellectual Organisation, WIPO and in EU-hearings.
     Companies outside Sweden use Bildombudsmannen to help them with their problems in the picture world. Bildombudsmannen represent members of Picscout www.picscout.com   on Nordic countries. Staffan Teste is member of an International law discussion group in Cepic. Every year lawyers from that group meet at Cepic conference in Europe.

Bilder från konstböcker

En fråga till: Har jag rätt att scanna in och använda bilder från konstböcker som visar reprofotografier av verk där upphovsrätten har gått ur? Från Wikipedia: "PD-art (Public Domain-art) template This is a faithful photographic reproduction of an original two-dimensional work of art. The original image comprising the work of art itself is in the public domain because its copyright has expired." (the photograph is not original enough to qualify for copyright protection) "In Denmark (Article 70), Finland (Article 49 a), Norway (Article 43 a), Sweden (Article 49 a), and Iceland (§49), anyone who has produced a photographic picture has an exclusive right to reproduce the picture and to make it available to the public Recent photos are thus never OK in those countries. However, mechanical reproduction such as photocopying and scanning are not mentioned in the laws, and are probably OK. Similarly, reprints using old etchings and copper-plates are likely not protected."

Det är som texten ovan beskriver skillnad i lagar i USA och Sverige. I Sverige har fotografen som har tagit en bild av t.ex.. Mona Lisa upphovsrätt till sin egen bild som fotografi enligt 49 a paragrafen. Det skyddet varar i 50 år efter knäppet. Det är alltså viktigt att kontrollera vilken bild som används och om fotografens upphovsrätt finns kvar.
